1. SCOPE AND CONTRACTING PARTIES
The currently valid ordering terms are available at any time on our webshop.
1.1 CONTRACTING PARTIES
These Order Terms (hereinafter referred to as "Terms") apply to all contracts initiated through this webshop (www.tipykeyboard.com). Contracts are concluded exclusively between TiPY GmbH (hereinafter also referred to as "TiPY GmbH", "we", "us") and you as the customer (hereinafter also referred to as "you" or "your").
The person authorized to represent TiPY GmbH externally is its Managing Director Matthaeus Drory. TiPY GmbH has its registered office at Eisentürgasse 9/6, 3500 Krems an der Donau, Austria and is registered with the Regional Court of St. Pölten under company registration number FN 475900 d.
The goods offered in our webshop are intended exclusively for persons with full legal capacity, generally those who have reached the age of 18.
1.2 CONSUMERS AND BUSINESS CUSTOMERS
A business customer is a natural or legal person who enters into a transaction as part of their commercial or professional activity. A consumer is any person who does not fall into this category.
For business customers, these Terms shall also apply to future business relationships without the need for explicit reference. If the business customer uses conflicting or supplementary terms and conditions, these are hereby rejected unless we have expressly agreed to them.
2. CONTRACT LANGUAGE
If you submit your order in German, the contract language is German.
If you submit your order in another language, the contract language is English. In this case, the current English version of our Terms applies.
3. CONCLUSION OF THE CONTRACT
All information regarding our goods and prices does not constitute a binding offer but an online catalogue. Only the submission of an order through the ordering process constitutes a binding offer from you.
You will receive an automatic confirmation of receipt of your order (confirmation of receipt). You are bound by this offer for two working days (Saturday, Sunday and public holidays are not considered working days). Your statutory right of withdrawal remains unaffected.
A contract is only concluded once we expressly accept your offer.
3.1 ORDERING PROCESS
Orders are placed exclusively through the webshop ordering process, which consists of the following steps:
– You can select goods without obligation by clicking the "Order" button and placing them in the shopping cart.
– In the shopping cart you may adjust quantities. By clicking "Checkout" you proceed to the next page where you enter your customer information. If you are logged into your customer account, stored information will be filled in automatically.
– You then select the shipping method.
– Next you choose the payment method. If you select PayPal or KLARNA SOFORT transfer, you will be redirected to the respective provider's website to complete the payment authorization. Afterwards you will be redirected back to our webshop.
– Before submitting your order, you may review and correct your entries at any time using the standard editing functions.
– By clicking the "Place Order" button you submit a binding order for the goods in the shopping cart.
– The receipt of the order is confirmed by email.
The contract text is stored by us and made available to you via email or a link sent by email.
4. PAYMENT TERMS
You are obliged to pay the purchase price upon conclusion of the contract.
We accept the following payment methods:
4.1 CREDIT CARD
When placing your order you provide your credit card details. After verification as the legitimate cardholder, the payment transaction will be initiated through your credit card provider.
4.2 KLARNA SOFORT TRANSFER
After placing your order you will be redirected to the website of KLARNA SOFORT transfer where you confirm the payment instruction.
4.3 PAYPAL
During the ordering process you will be redirected to the PayPal website. In order to pay via PayPal you must be registered there or register first, authenticate yourself with your login data and confirm the payment instruction. After placing the order we will request PayPal to initiate the payment transaction.
5. DELIVERY CONDITIONS
We deliver goods exclusively by shipping. Delivery is made to the shipping address provided during the ordering process.
6. PRICES
All prices are stated in Euro and include all applicable taxes for Austria, Germany and Switzerland.
For other countries, the applicable national tax will be shown separately.
Shipping costs depend on the destination country and will be displayed before the order is submitted.
8. TRANSPORT DAMAGE
8.1 FOR CONSUMERS
If goods are delivered with obvious transport damage, please report such damage immediately to the carrier and contact us without delay. Failure to report does not affect your statutory rights, but helps us assert our claims against the carrier or transport insurance.
8.2 FOR BUSINESS CUSTOMERS
The risk of accidental loss or deterioration passes to you as soon as the goods have been handed over to the shipping company or carrier. Business customers are subject to the obligation to inspect goods and report defects.
9. RETURNS
The procedures described below are not a prerequisite for exercising the statutory right of withdrawal.
Please avoid damaging or contaminating the goods. If possible, return the goods in the original packaging with all accessories and packaging components. If the original packaging is no longer available, please use suitable packaging to protect the goods from transport damage.
10. WARRANTY AND STATUTORY GUARANTEE
In addition to statutory warranty rights, TiPY GmbH grants a two-year warranty against defects caused by material or manufacturing faults. The warranty period begins upon dispatch of the goods.
Within the warranty period, defects will be remedied either by replacement or repair at our discretion. The warranty applies to the TiPY keyboard but does not include the supplied USB-C cable.
The warranty does not cover damage resulting from improper use, normal wear and tear or minor defects that do not affect the value or functionality of the device.

12. LIABILITY
We are liable without limitation for damages caused by us, our legal representatives or agents:
– in the event of injury to life, body or health
– in the case of intentional or grossly negligent breach of duty
– in the case of warranty commitments
– where liability under product liability law applies
In the event of slight negligence involving essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
13. DISPUTE RESOLUTION

15. FINAL PROVISIONS
If you are a business customer, Austrian law applies excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a business customer, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us is Vienna.
